2. Purpose and scope
These Terms of Sale govern sales made on the Injexo website between TM Trading Group LLC and any person placing an order.
The customer confirms having read these terms before validating their order. Confirming the order constitutes acceptance of the version applicable on the day of purchase.
Consumer protection provisions apply only where the customer is acting as a consumer or non-professional. A professional customer must state that capacity when ordering for the purposes of their business.
3. Products
Injexo sells injectors and parts related to automotive injection systems. Essential characteristics, part numbers, prices and availability are shown on each product page.
Photographs and packaging are reproduced with the greatest care. Slight differences in presentation may exist without affecting the part number or the essential characteristics of the product.
4. Fitment and choosing the right part number
An injector is not a universal part. Its compatibility depends on the exact part number, the engine, the engine code, the VIN, the connectors, the calibration and the manufacturer's data.
The customer must compare the number marked on their old part with that of the product ordered, and provide accurate information when requesting a check.
Any assistance or verification is carried out on the basis of the information supplied by the customer. A confirmation does not replace a mechanical diagnosis where the fault or the identification of the vehicle remains uncertain.
5. Prices, taxes and charges
Prices are displayed in the currency shown on the site. The total amount, applicable taxes and delivery charges are shown before the order is finally validated.
Orders are delivered DDP (Delivered Duty Paid): customs duties, import VAT and clearance fees are paid before delivery, including for destinations outside the European Union offered at checkout. The amount shown at checkout is final and there is nothing to pay the carrier on delivery.
Injexo may change its prices at any time. The price charged remains the one displayed when the order was validated, except in the case of an obvious error that the customer could reasonably have identified.
6. Ordering process
The customer selects the products, reviews the cart, provides the required information, chooses delivery and payment, then confirms the order using the button indicating an obligation to pay.
Before confirming, the customer can correct input errors. A confirmation is then sent to the e-mail address provided.
Injexo may request additional verification in the event of an anomaly, suspected fraud, an incomplete address, unavailability or serious doubt about the part number.
7. Payment
The available payment methods are shown at checkout. Payment is processed by secure providers integrated into the Shopify platform.
An order is dispatched only after payment has been authorised or collected. In the event of refusal, non-payment or a necessary check, the order may be suspended or cancelled.
8. Availability
Offers are valid while stocks last. Where a product becomes unavailable after the order, Injexo informs the customer as soon as possible and offers, depending on the situation, an equivalent product accepted by the customer, a wait, a cancellation or a refund.
9. Delivery
Delivery areas, charges, terms and timeframes are described in the Shipping Policy and shown before the order is validated.
Where a product page states “dispatched within 24 h”, this refers to the usual time for handing the parcel to the carrier, in working days, for a product in stock — not a guarantee of delivery to the recipient within 24 hours.
The customer must provide an accurate and accessible address. Any error that may prevent delivery can result in additional charges.
10. Transfer of risk
For consumer customers, the risk of loss or damage passes when they take physical possession of the product, unless they themselves choose a carrier not offered by Injexo.
11. Right of withdrawal
Consumer customers have 14 calendar days from receipt of the goods to notify their decision to withdraw, without having to give reasons.
Notification must be sent to contact@injexo.fr. The product must then be returned within 14 days of that notification.
Direct return costs remain payable by the customer in the case of a simple withdrawal. Detailed terms are set out in the Refund and Return Policy.
12. Condition of returned products
The customer is liable for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the product.
Fitting, coding, exposure to fuel, contamination, modification or damage to an injector may result in a significant loss of value. This rule does not limit the customer's rights where a defect falls under a legal guarantee.
13. Refund
In the event of a valid withdrawal, Injexo refunds the sums due, including the cost of the initial standard delivery, within a maximum of 14 days of notification.
The refund may be withheld until the product has been recovered or proof of dispatch has been received. Additional costs arising from choosing a more expensive delivery method than standard delivery are not refunded.
14. Legal guarantees
Consumer customers benefit from the legal guarantee of conformity and the guarantee against hidden defects under the conditions laid down by the applicable regulations.
The legal guarantee of conformity may be relied on for two years from delivery of the goods. It applies independently of any commercial guarantee of 12 months and cannot be reduced by it.
Where a covered defect exists, the consumer may request repair or replacement of the product under the statutory conditions. A price reduction or termination of the contract may apply where bringing the goods into conformity is impossible, disproportionate or is not carried out under the conditions provided for by law.
15. Installation, coding and maintenance
Fitting an injector may require a diagnosis, cleaning of the fuel system, replacement of surrounding components, coding or calibration. Installation by a qualified professional is strongly recommended.
The customer must follow the vehicle manufacturer's and the parts manufacturer's recommendations. A failure caused solely by incorrect installation, contamination of the fuel system, unsuitable fuel or use contrary to the instructions may not constitute a defect of the product, subject to the legal guarantees.
16. Liability
TM Trading Group LLC is responsible for the proper performance of its contractual obligations within the limits provided by law.
It cannot be held liable for damage resulting from inaccurate information supplied by the customer, an incorrect diagnosis, non-compliant installation, modification of the product or an unforeseeable and irresistible external event.
No provision of these terms has the effect of excluding or limiting a mandatory right granted to consumers.
17. Personal data
Data required for orders and customer relations is processed in accordance with the Privacy Policy available on the site.
18. Intellectual property
The content of the site, the Injexo brand, texts, visuals, graphics and technical elements are protected. Any unauthorised use is prohibited.
19. Force majeure
Neither party may be held liable for a delay or failure to perform caused by an event meeting the criteria of force majeure under the applicable law. The party concerned informs the other party and takes reasonable steps to limit the consequences.
20. Complaints and amicable settlement
Before any proceedings, the customer is invited to send a written complaint to contact@injexo.fr, stating their order number and any relevant details.
Injexo seeks an amicable solution within a reasonable time, without depriving the consumer of their right to bring a claim before the competent authority or court.
21. Governing law and jurisdiction
These terms are governed by the law applicable to TM Trading Group LLC, subject to the mandatory provisions protecting consumers in their country of residence.
A consumer residing in France, the European Union or the United Kingdom retains the benefit of the mandatory protections applicable to them and may bring proceedings before the competent courts in accordance with the applicable rules of procedure.
22. Cancelling an order
A cancellation request must be sent to contact@injexo.fr as soon as possible, stating the order number.
As long as the order has not been handed over to the carrier, the cancellation is accepted and the order is refunded in full.
An order that has already been dispatched can no longer be cancelled, as the parcel is in the hands of the carrier. Consumer customers then keep their 14-day right of withdrawal from receipt, under the conditions set out in article 11 and in the Refund Policy.
